Terms of service

General Terms and Conditions of Sale / Service

1. Purpose

These terms govern the services offered by Toujours Présent: cleaning, weeding, grave care, photo reporting and optional flowers.

  • Optional artificial flowers
  • Fresh flowers by quotation
  • Travel outside the normal service area by quotation

3. Quote requests

Any request submitted through the website is a request for an estimate. Displayed prices are indicative and must be confirmed after checking the grave, its condition, location and requested options.

4. Order confirmation

The service is confirmed only after the customer accepts the quote and, where required, provides the service authorisation.

5. Prices

One-off visit: €119. Essential: €229. Peace of Mind: €399. Regular Care: €579. Premium: €990.

Artificial flower options: mini pot €15, small pot €25, medium pot €39, large pot / large arrangement €59, budget two-mini-pot option €29. Fresh flowers: quotation required.

Prices are indicative and may be adjusted according to the actual condition of the grave, accessibility, location or the customer’s specific request.

6. Payment

Payment terms are specified in the quote. Payment may be required before the service unless otherwise agreed in writing.

7. Service performance

The service is carried out after the quote and customer approval have been received. The customer agrees to provide the information required to identify the grave.

8. Service authorisation

The customer confirms that they are authorised to request work on the grave concerned. Toujours Présent cannot be held liable for inaccurate information supplied by the customer.

9. Before-and-after photos

Photos may be sent to the customer as evidence of the service carried out. They are intended solely for service follow-up.

10. Flowers

Flowers are optional. Artificial flowers are subject to stock availability. Fresh flowers are available only by quotation, depending on the season, availability and budget.

11. Cancellation / postponement

In the event of adverse weather, lack of access to the cemetery or any circumstance preventing the service, Toujours Présent may propose a new date.

12. Right of withdrawal

Where the service is ordered remotely, a consumer may have a statutory right of withdrawal under the French Consumer Code, unless performance has begun with the consumer’s express consent before the applicable period expires.

14. Consumer mediation

Conformément aux dispositions du Code de la consommation, le client consommateur pourra recourir gratuitement à un médiateur de la consommation en cas de litige non résolu directement avec Toujours Présent. Les coordonnées du médiateur seront ajoutées dès finalisation de l'immatriculation et de l'adhésion au dispositif de médiation.

16. Governing law

These terms are governed by French law.
